Custody – Visitation Support Order

My 18 year old son has a child with a girl who is 16,Her and my sons daughter reside with her mother, There has been no visitation or support order in court, We would like to know who has legal custody of the child until we go to court, The baby mother which is 16,or her mother since she is underage?The grandmother keeps saying she has a rights to the child, My son is 18, would he not have rights before the grandmother?? The grandmother says shes going to sue for custody of the child and will not allow my son visitations.

there has been no court ruling giving either parent custody and the father is not even on the birth certificates. The mother has both children. if she allows the boys to go stay with their father in another state can he keep them from her and get her for abandonment or anything.
