I live in Florida and moved out of my home two years ago, My spouse and I have a close relationship and still see each other and spend the night at either our house and my apartment.

My friend is trying to blackmail another friend, because she would sneak him into the house once in a while and says if he does anything wrong she is going to report him for breaking and entering. I was wondering, technically the “crime” was never reported, they have no physical evidence except for a he said she said, and he didn’t steal anything. If she chose to report him for breaking and entering (She is a minor, her father would do the reporting) could it technically be a B&E or would the charges be a misdemeanor, maybe a slap on the wrist but nothing serious due to lack of physical evidence
