I have a patent case (pro se) in the Federal Circuit Court of Appeals and it was dismissed in May 2010 because I failed to submit a brief appealing a final judgment although it didn’t say with or without prejudice. Few days ago I file a Motion to Recall the Mandate.

However, few days ago I filed a Motion to Recall the Mandate. If the motion is granted, can I still go to the district court and file a motion to amend new complaint in the district court
