My ex will not give me any money for child support. He said he will stop paying our mortgage if he pays for the baby! Is this legal? My son is 9 months old and we have not lived in my house for 3 months

I have a special case. I have a nephew on my husband’s side who wants to emancipate himself legally from his mother who is the closest living parent to him right now. He has been living with us for almost five months.
